I have box art in jpg format directly from the developer. I can PM it to anybody if they are willing to make a DS-sized cover for this amazing release.

We won't be able to host the cover but i'll make it and add it to my box.net account. Just add the image to the "Raw Cover Scans" part of the site.

Correct, we don't host any covers that are not officially licensed by the respective game console company.  Any covers that are on the site now (like the R4 DS cover) were uploaded before we came to this decision and were a mistake to host.  The last thing we want is for Nintendo to get mad and shut us down at the flick of a finger  :-\

I guess that's understandable. Though I feel like the Qwak release is a lot more on the up and up than a flashcart. But rules is rules, so I understand. Anyway, if someone could still help me out that would be awesome!

I don't mean to beat a dead horse or anything, but I'd imagine nintendo would try to shut down the makers of the R4 itself before it went after a website providing a DS cover printout for one.

Same thing with reproduction carts, they'll shut down the sites that offer that service before they'll shut down us, what we do amounts to little more than somewhat functional fanart.

I wish this site would honestly be a bit more lax on these sorts of things, since it does not and cannot "enable" piracy or what have you in anyway, but I suppose you'd rather be especially cautious than put yourself in a position that would endanger this website or its content. I get it, I do, but you understand what I mean.

Sorry I'm rambling, don't mean to rant or go off topic.

I was actually thinking that Nintendo would be more prone to make the site take down the actual cover scans of their copywritten products than they would care about scans of unlicensed games. But again, this is not my site. And I'm just happy it exists!

Here's the thing though... Nintendo really, really doesn't like things like the r4.

Now, while, technically, we are skirting/breaking copyright laws in the unauthorized distribution of Nintendo's cover art (I say skirting, because there's an argument to be made about fair use and cover images being promotional material), as long as we don't do anything to just piss Nintendo off, they probably won't care about us.

Now, if we pissed Nintendo off (by doing things like, say, blatantly supporting piracy), then there's a good chance they'll try to shut the site down for no other reason than because we pissed them off.

See, the thing is that hosting printable covers for unreleased and unlicensed games doesn't really enable or even endorse piracy in any way anyhow. Let's face it, most pirates don't care about making their collections look pretty, they just want free stuff. What we do is pretty harmless, I'm pretty sure these companies lawyers and PR departments would see it that way as well.

Like others have said, we're more likely to see the site shut down for the LICENSED covers we host before we'll see them go after the unlicensed ones.

EDIT: and as for skirting copyright laws, nintendo doesn't care, seriously. Ever heard of MFGG? It's a mario fangame website. The games they host have liberal use of copyrighted content, including spirtes, voice samples, etc. not to mention unlicensed use of the characters. The forums were once visted by Charles Martinet (you know, the Mario voice guy) just for casual discussion. Nothing bad ever happened to the place (well other than the community degrading severely, but that's a rant for another day). The fact that Charles Martinet has visited tells me that Nintendo themselves definitely knew about the place, and obviously didn't see any danger going on. That place is obviously skirting copyright way more than us, I imagine if they knew about this site (which they likely do) they wouldn't care about it either.

I was only really mentioning in reference to the r4-like devices.  Ideally, I see no harm in hosting covers unreleased games and such... except for the possible degrade in quality.  That's not a knock on anyone - but I don't think it'd really help the site if we had a bunch of covers that one or two people are going to want (and this is coming from the guy who put up $10 to get a single cover made for an unreleased prototype!).
