Ya. But some games like Shovel Knight that are download only are too good to pass up! Man, I wish developers could always do a physical release.

Already having purchased Shovel Knight on 3DS, I would buy it again in a heartbeat if they released a physical copy.

Shovel Knight is fantastic. The way they used the 3D for a pseudo- depth-of-field effect was pretty cool.

And to answer the topic question, I've found the 3D effect to be a lot more tolerable since there's no sweet spot and it doesn't seem as straining on the eyes. What use the ZL and ZR buttons are gonna play I have no idea yet; Only game I've seen that uses them so far is Smash Bros. and even then they're just used as the reverse of regular L / R so you can use both moves with one finger.
