I am going to email Nintendo and get some answers on what Nintendo considers fair use, I see the program guided at Let's Plays and not at reviews. I could be wrong, and if I am, then my opinion on the program will change.

I would have no problem with this.
And Fritz, I am not directing this at you, we've interacted before and you're a cool guy, but rather I'm referencing people on the internet as a whole. And when you build a career working in politics and fighting overbearing legislature, you tend to develop a bit of an argumentative personality

Thanks man, you're alright too.

Nintendo announced the program in 2012, but it wasn't scheduled to come out until this year. That was the plan. Claim everything, then offer this back to the people.
Going back to what was said earlier, now that Nintendo has control, they can decide what goes and what stays. You bad mouth Mario Kart 8? Nope. Not getting posted.

I din't think that will be the case. Nothing in the terms of service contract I agreed to says you can't say anything bad about Nintendo. Maybe you can interpret 'objectionable' but that owuld not fall in well this the list of other things.

My videos have fairly heavy cursing, I wonder if they will be ok. I'll know probably tomorrow or Monday.
This is one of the two.

oh man, i'm late to the party/fight. I'm gonna have to make me a coffee, read up on this and watch all your guys' videos to get what's going on here. You can make money off of you tube by talking about videogames? And nintendo is trying to take their cut if you are talking about their games? Is that what this argument is about? Needless to say TLDR thus far but ima change that!

TL;DR:
People using Nintendo footage and music in YouTube videos in reviews and Let's Plays, and making money off ads. Nintendo and YouTube are using the content ID system to match and take ad revenue from videos using certain games. Nintendo launched the Creators Program to split ad revenue with content makers. YouTubers pissed off they have to pay for using Nintendo's Copyrighted material, some with merit (Reviewers protected by fair use) some without (Let's Players where fair use does not apply or is in a grey area)
I have a Let's Play channel and have no problem with sharing ad revenue, I see it as a licensing fee.

No? Not his fault? I'm too busy to have an educated opinion regarding this subject so I'll just keep my mouth shut. I spent my book learnin' time in academic areas other than law, and simply use TCP for the awesome artwork! I guess I can see both points of the argument presented in this thread; but then again I try to live my life in the gray area. It's kinda like Patrick Swayze's (in Donnie Darko) attempt to categorize everything as Love/Fear. Man, there's a whole bunch of other emotions between those two!
