Nope, unmodded Wiis, although Nintendo can pretty easily catch you when their records of downloaded VC games don't match your console. Then they could in theory ban your console from online. To my knowledge, this has never been done. You can also use it to run homebrew and emulators (plus games that aren't on the VC yet) I don't have TP, so I've been trying to mooch one off of my friends ever since this capability was unlocked.
