How on earth is there any sort of question regarding legality?! The patents are WAY up for the NES/Fami and this is just a piece of hardware, not bootleg software. There's nothing about it that could be a patent or copyright violation.
That said, I still think it's a rather unattractive chunk of hardware. The whole "solid block of aluminum" thing only matters if it's at all attractive. It just looks like a plastic clone to me :-\

Only place I see even mentioning the legality of it is yahoo. I think they're getting it confused with emulators.

Putting a playchoice PPU in a NES wont give you VGA out, it'll get you RGB out with an incorrect colour palette. To get proper RGB out from a NES you can buy Viletim's newly released NESRGB board. No saccing required.
For this to be using original hardware and have VGA/HDMI out it'll have Viletim's RGB board and a small upscaler. At a guess i'd say this is using a modified version of the Super8 NES and the NESRGB board running into a Gonbes 8220 upscaler with a small SLG. Impossible to tell until someone opens one of these up though.

I did not know anyone made an RGB board for the nes that didn't involve destroying a nes ten. Looks like he's out of stock though.
