being relatively new to ebay, I went through the contact seller process regarding no communication. Remember when I bought Paws of Fury cart? the guy never marked it shipped and did not write to me. I waited one week and two days. I decided to contact seller and instead, I opened a case. I thought, "what?" I just wanted to contact the guy first. I decided this time to just use the old auction page to "ask a question" LOL. incidentally, he sent the item but never marked it as being shipped. I suppose he could be busy and just forgot to do so.
I'd hate to damage someone's credibility over a simple error. I am learning as I go. all is well. I wrote to the guy and he responded.
I got a free scan out of it ;D
i'm watching NHL playoffs now. I'll scan box/manual tomorrow.

How are you trying to contract the seller? Through the resolution center? If so, that's why.

ebay error #1
I just got SFC Mask CIB today but I actually won an auction for Pinocchio.
On one hand, I am happy because I may be able to get a free scan of Mask.
on the other hand, I have to try to rectify the matter and I could end up getting stuck with Mask.
has this happened to anyone on TCP?
do I contact ebay about the matter first?

You should open a case with eBay. However by doing this you will be contacting the seller first. Give him a chance to resolve the issue at his cost. If this doesn't happen, get eBay involved by escalating the case. Just make sure you do everything within eBay's time limit (which is pretty long).
With a feedback rating of approximately 150, I've only had three bad transactions on eBay. All three times, the seller resolved the issue at no cost to me. All three sellers ended up with positive feedback from me. No one is perfect. Everyone makes mistakes. What's important is how someone handles their mistakes.

As a seller, I can't stand when people default to simply opening a case. It actually slows down the whole return/refund/replace process when I am more than willing to help someone should they just send a message. Same with PayPal.

Interesting, becaues the last two times I tried to do this very thing, eBay would NOT let me send the seller a message without opening a case. I assumed that it was somthing new and that opening a case was a requirment. I wonder what I was missing because I can assure you that I tried very hard to avoid opening a case.
Since I assumed that opening a case was a new requirement, that is why it was my suggestion to noemann. However, I was trying to make a point to NOT escalate the case unless the seller didn't respond because I felt that would slow down the process as you suggested.
I'm a seller too, so I understand.

That makes sense and I will try that if I ever have to do that again. Although, for the record, I don't feel that you hurt anyone's credibility by opening a case. If the case is resolved and closed, no one gets hurt. Leaving negative feedback is what will hurt someone's credibility. Fortunately, I've never had to do that.
