I know the tune that plays when you wake up from a Inn is "Good Morning Good Morning" And another one samples the first 3 notes of All You Need Is love.

Some tracks from Banjo Kazzoie and Golden Eye are also taken from real songs, the composer was talking about them on Game Grumps, a YouTube show.
They may keep in most of it, I think the can get in the most trouble over the tracks were they sampled the original recording, like Sgt. Pepper (Reprise) and All You Need Is Love.
I know Bomb Jack used [ur=http://www.youtube.com/watch?v=bPGYPTMB6ls]Lady Madonna[/url] and got the rights in the original arcade ver, but In a Xbox port changed the track with a NES tune or something.
If they pay royalties, they got a lot to pay out, The Beatles, The Who, The Doors, Chuck Berry and Pink Floyd and more.
So many games using Beatles tracks.
And the Wuu, will be good when It has some games, that will happen eventually, right?

I remember having my 3DS shortly after launch just sitting there gathering dust then Mario Kart & 3D Land came out and it seams like just about every week between retail and eShop there is something new. That's what gives me hope for my Wii U. It really sucks waiting though.
