People have long believed that it would be nearly impossible to re-release EB in the US, but copyright laws work a lot different than many folks think.  I'm willing to be that it'll happen, and when it does, I'll gladly buy a hard copy for sub-50 dollar prices again ;D

I doubt NOA will release EB...and I don't think it is the music. Frankly, there are more games than just EB that sampled music for its sound track and have been released time and time again without fear of litigation. Nintendo was bit in the ass by Earthbound being a flop, and Reggie does not want to make the same "mistake" as Howard Lincoln. Nintendo as of late have had issues releasing non Miyamoto games to NA for fear of them flopping, which is why Operation Rainfall occurred.

Frankly, I think its Nintendo ignoring the fanbase that has grown, not seeing them as true potential customers.

With the music, many other games has stolen music and got into the VC:
Donkey Kong -- The Beatles - Ballad of John and Yoko
Yoshi's Island / Super Mario 64 -- The Bonzo Dog Band - Keynsham
Zelda 2 -- Queen - Father To Son
Super Dodge Ball (NES) -- The Beatles - I Wanna Hold Your Hand / Get Back / A Hard Days Night
Battle Dodge Ball (SNES) -- The Beatles - I Feel Fine

While the games above did only make sound alikes, Earthbound did also sample the original recordings of Sgt. Peppers (Reprise), All You Need Is Love, and the Monty Python's Flying Circus theme.

I also do not think having the gae on VC will lower the price significantly, Look at other rere games that are in the VC.

Larry while your theory may be true I do know that (being a HUGE shmup guy) That once Radiant Silvergun hit XBLA it went from 200$ price tage down to 100$-125$.  I know this is just one example but it does happen.    Oh also MvC2 went from about 70$-80$ used down to about 40$-50$ one it hot XBLA and PSN.

Final Fantasy VII used to go for $70 for just the discs, now it goes for $30 because of it being released on the PSN.

Here are some examples just from Sonic 1 of "stolen music"

Marble Zone theme/Music to watch Girls by- Andy Williams
Spring Yard Zone/Every Little Step-Bobby Brown
Final Zone/Planet Earth-Duran Duran
Scrap Brain Zone/the end theme from Blade Runner

Chrono Trigger
Robo's Theme/Never Gonna give you up-Rick Astley
The Kingdom Trial/The Trial-Pink Floyd

And there was one I recognize from Shenmue II, the track "Departure on a new tip" has a part of it lifted from the guitar solo of some song I do not know (I wish I did)

To be fair, it's called sampling and it was entirely legal without acquiring any sort of rights from the creator back then. So none of these games were technically stealing, from a legal standpoint. That's long since been amended though. 

Not to mention that some bits and pieces simply don't fall under copyright (see all the drum beats of Jabo Starks). 

I think the more inflated the cost of a particular game, the more likey it is to fall, and EB is so overly inflated at this point.

Next up: EVO on VC please! ;D

While we are asking for games on VC, how about some Little Samson love??

If Japan Wii U owners are getting the same promotion as those in North America (The Virtual Console Trial Campaign), then they will have the opportunity to buy Earthbound for THIRTY CENTS.

I have herd mixed things over sampling, I know many artists have to pay for samples, I think I heard the most exspensive one ever was "Tomorrow Never Knows," MAny samples slip through, and there are some songs that use the tune of another without taking the original recording ("Why Don't You Get A Job" Offspring, "Oh-Bla-Di Oh-Bla-Da" Beatles)  There are many lawsuits and such, even if some are legal, the original artist can still try and sue.

I remember something about "The Grey Album" A mash up of The Beatles "White Album" and Jay-Z's "Black Album" both Jay-Z and Paul McCartney said they felt fine with the project but EMI still tried to sue.

The part sampled from All You Need Is Love, was the "Claude Joseph Rouget De Lisle" intro to the song. And the MPFC theme is "The Liberty Bell" both in the public domain. But seeing how the sample was taken from the Beatles and Python versions, I think it is a grey area.

But it is also another thing to copy large portions of:

It's a SUPER difficult area in copyright law and the laws governing such things are constantly evolving. 

Not an area of law that I'd want to be involved in (or any civil law for that matter).  My attorney friends all groan when the subject comes up.  After many stories from they and their colleges, I know why  :-\

I don't think EarthBound's price is going to change at all if Mother 2 hits the Japanese Virtual Console. That is meaningless to the prices of EarthBound, only the prices of Mother 2, which are already pretty low.

It's 2013 now. If EarthBound was released, I don't think it was have the same kind of impact it would have a few years ago. The hardcore gamers would take notice, but I don't think the Virtual Console gets the attention from casuals as it did a few years ago.

Also, SNES RPG prices seem completely unaffected by digital releases. Prices are still high for Chrono Trigger, Final Fantasy 6, Final Fantasy 4, Lufia, Secret of Mana, Mario RPG, you name it.

I don't see the prices changing by much.

i found EVO at a local pawn shop for 5 bucks.. the guy had FF2, FF3, and Super Metroid there too.. he said he looked them up online and that's why they're 15 a piece.. i took all 4 games.. LOL

But also, EarthBound appeared on Nintendo's ESRB rating site thing for the Virtual Console in 2008. There was speculation then that it meant it was going to come out. I personally don't think it ever will. Too many skeletons in Nintendo's closet with their refusal to localize Mother 3, release the fully finished Earth Bound prototype, or even acknowledge the fan community.

In the meantime, a guy over at NintendoAge is making Mother 3 reproduction carts with the amazing Mother 3 fan translation while Nintendo continues to do jack shit with the property. I'd sooner expect Nintendo to release the Super Mario Bros. 1 Genesis bootleg on the Virtual Console than EarthBound.
