The problem lies in the fact that we are "hosting" "copyrighted" material that is easily distributed / printed.  That in itself can make us held accountable and backfire.  We are just providing a service for those who are in need of covers.  The fact that Nintendo's logo is "plagiarized" all over the place on our website is also a bad thing.  So I mean, what can we do =\  Atleast we are not going to the extreme and SELLING our covers for a PROFIT

Uh oh, Paula...what happened?  Weren't you going to sic your big bad lawyers on Wiggy and the rest of us here on TCP as well as possibly everyone else on the internet?  I'm guessing the 'advisement of many' were the two lawyers you called and laughed in your face?  ;D

Actually this was not the old story of them selling the covers, but review of their product quality, well in the beginning anyway, see first post.

I decided to let this run it's course, which it pretty much has.

And this topic produced 1 new custom cover and another is in the production.

After those are done this goes to "Mappi Ö"

I would have no problem if she posted "95% of my covers I am selling are from TheCoverProject and I/Paula have only fixed minor grammatical errors (such as errors on the back [which there are rarely grammatical errors to fix on RETAIL COVERS]) and I salute those who take their time into scanning their covers (Akrate and ShoothimNow) and those who update them to look amazing (Shenske, Tik, BadChad, etc).

To say: "I created MOST OF MY COVERS and "such" website is a bully for terrorizing my company...", well I would personally like my batman cover removed from her website. =X

I personally feel that an IP ban is long overdue, especially considering that she CAN'T even share with us now that she's deleted her account.  She's of absolutely zero use to this community.

This has come up a zillion times.  Nobody here (well, nobody in any position to make a decision like that) wants to bring that sort of attention to the site, not to mention the entirely life-consuming process of bringing civil charges.  I don't blame them one bit.  The big thing to remember with civil cases (like suing someone) is that you MUST PROVE loss.  Being that this site is not generating any sort of substantial income (or income at all) as a result of the covers made, there aren't any losses to claim.  You can't sue just because you feel that you've been wronged or because you just don't like what someone else is doing.

Plus, there is very little from almost all of our covers that we can lay claim to as our own.  Even the templates themselves. They're just a collection of copyrighted icons and logos that none of us own.  Even covers with original art, like Paula's Earthbound cover, aren't really ours to claim.  None of us have obtained a license to use the characters and whatnot for these games, which means that there's very little anyone could do in order to prevent redistribution of the work.  The webernets have made it far more difficult to keep copyrighted material from being abused in the way that GCW does.

What we do is right in the middle of copyright infringement and harmless sharing.  If someone wanted to press charges, then it's entirely possible that the owner of any art in question would have it pulled from the site, or even worse, shutting the site down.  Being that nobody here is making any money doing this, it would be hard to find a lawyer that would have any interest in suing.  There would be no money to make from such an endeavor.  BUT, on the other side, companies like GCW and others could most definitely face such charges, especially when you consider how easy it is to see the quantity that some is moving when selling in eBay.  There's a feedback record with links to each transaction.  ANYONE can see what these guys have sold in the last few months, and discovery would turn up ALL of their transaction details for the prosecution to use as evidence.  They could very possibly find themselves in civil litigation, which makes it all that much more absurd that Paula would bring more attention to what GCW does.
