So a friend of mine bought some Animal Crossing toys from the user "jessicayu3" on eBay here is the ORIGINAL LISTING. It was $98 with $12 shipping.

He bought an item on August 3rd. On the 8th the person sent a message saying that the house has been remodeled and due to that, the item has been missed place. He was given the option for a refund or to wait until its found. He chose to wait because he want it and its hard to find, but still have not received it. About a week ago, the 18th He sent an email asking for a refund in one week. To this day he has not heard from the seller. He just sent the seller another message for a refund within 3 days or he will take action. Assuming that he just got ripped of what should he do?

Well, if he paid via Paypal, he can file a complaint with them.  Paypal nearly always sides with the buyer.  The seller would need to provide Paypal with proof that the item was shipped; otherwise, Paypal will force the seller to issue a refund.

Crappy deal, larryinc64. I've been very fortunate with ebay so this doesn't come from experience, but it seems like he may have to do what redsox2012 suggested and drop the hammer, paypal style.

I know there are other on these boards who can provide better insight as to what to advise your friend to do, but it seems like should definitely start the process of getting that $100 back.

he will have to file a claim/report with eBay. He will also have to include any messages back and forth between he and the seller. Assuming the seller is actually ignoring him he should see his money back (PayPal will just take it from the other guy)

It has been resolved. The seller got his last message and he got a refund through paypal. No hassle.  ;D

Hahaha eBay is perfectly safe if no one panics and just follows the procedure if they get bamboozled. PayPal and eBay will always go beat up the big bully that stole your lunch money.  ;)

Now selling on eBay, talk about a place where there's absolute no protection.... :o
I'm looking for vol. 2, 4, and 5 of the Orchestral Game Music Concert CDs. I'll pay well if it's authentic and doesn't skip. :)

Man, ain't i tthe truth!  I've lost count of the number of times I've sold something, only to have the buyer disappear off the face of the Earth.  Sure, you can complain to eBay, but the most they usually do is put a strike on their account.  I wish eBay would do more to ensure that sellers receive their payments, but that's just not the case.

Great example: I recently "sold" a set of Gamecube component cables, where the auction ended for $182.50.  It's **way** more that they're worth, and at first, I was overjoyed... until I realised that I would never, ever get paid for that auction.  Three weeks later, and sure enough, the seller has asked me to cancel the transaction, or to try and "settle" for a smaller amount.

I love selling on eBay, but sometimes, the non-paying bidders can really give it a bad name.  I'd say 90% of the buyers are legit, in my experience, but there's always a few that just treat it like a game, and never want to follow through.  Grumble, grumble...
