It's a gray area. We don't own the copyright, but we also don't charge for it so we are not profiting off someone else's work. We provide it as a free service to the community. If the copyright owner submitted a request for us to remove their work, we would have to.

We're not exactly making boxes too, right? They're plastic cases not like the original boxes that the NES, SNES, N64 and GBA games came in.

It's VERY VERY illegal. In fact, just for registering your account you are an accomplice and will be prosecuted with the rest of us to the fullest extent of the law.
