The vast, vast majority of people buying used (recent) games on eBay aren't collectors though.  They're moms buying games for their 4 year old who got a hand-me-down Game Boy Advance.

Before you send it back, open up the casing and drill a small hole through the game board.  Close it back up so if he does resell it, he'll have to deal with another return on it as well.

Some of the games that are like SNES and N64 that claim to be brand new could also be bootleg,  It doesnt take much hard work to print up a box and cartrige and plastic tight it.  I saw a PSone game claiming to be brand new and wraped up, but it was missing the Playstation seal sticker on the top, if anyone remembers them.
