just as i said, your supposed to create the rom yourself and keep it to yourself, then it's legal, if you sell your original game you have to destroy/delete the game image you had created. and when you download a rom your allready own as an original and it's the same region it's not illegal. if you have an original of Terranigma EU and you download a rom of Terranigma JP, it's illegal as hell. i know it's all very confusing, so yes Public Rom Images are illegal, but if an original game owner downloads one and he gets caught, there is nothing to worry about. ;)

here it is explained in a much better way.

Ontopic: sorry for the little offtopic there

Look what I found on Nintendo site:

Can I Download a Nintendo ROM from the Internet if I Already Own the Authentic Game?

There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a Nintendo ROM from the Internet. (I have bold what is important).

Anyway, we must talk with Byuu to post the manuals and the covers :D It's sad to stay there on his pc and not share with others.

I just bolded to you what i have been talking about the whole time in the previous post, if you read it very carefully maybe you get to understand what i was talking about. i'm talking about creating your image yourself wich as you can see is not illegal. so if you download a rom from the net wich is the same as the original you own, nothing is going to happen to you. of course emulators are illegal as hell in combination with roms. and if you keep reading the whole site you see why the whole public rom is illegal in nintendo's eyes.

Emulators themselves aren't illegal at all. Roms, yes, emulators no.

indeed, but that's what i said.

In combination not on their own ;). but lets quit the offtopic before one of the admins "in all their right" complain :)

if byuu doesnt want to share then ok, a little scared for nothing, all nintendo does when someone does something illegal "of course something that isnt of big importance" is demand to take it off his site a.s.a.p. how do i know this? when i was back at IT school a friend of mine used to make repro's of snes games here in holland, he made quite some money out of it until they demanded for him to ceace his repro production.
