Ok xxdeszarasxx, I understand what you've said but why they don't let retro roms to be downloadable? Many examples are romulation, romnation that have restrictions on some roms for copyright infringement... I think they have all the power to restrict/cut/remove/ban etc the covers for being used freely. Anyway copyright remain copyright even if you post something that you think is "free" (not for sale/resale). |

Man you really have to differentiate a bit. Playing, owning and downlaoding of roms without having the original is copyright infrigement at it's finest! Using altered cover art for a completely different case type than orignally intended is a whole other pair of shoes even if not 10000% legal! |

Tiktektak my point was this: anythime Nintendo can shut down the site for copyright infrigment (if they are crazy/paranormal) even if we don't sell the covers and put them freely. The covers in the first place are licensed by Nintendo (copyright). I think replacementdocs was having some problems with the copyright for some manuals. And from my point of view "THIS IS MADNESS". But they have the copyright, they have the rights. Byuu made that decision because he thinks that can have legal problems with Nintendo in the future. I was thinking to talk with him and to show him (but I think he knows about TCP and other sites with covers) that TCP and the rest of the sites are alive and no legal actions have occured from Nintendo. Anyway copyright remain copyright even if you post something that you think is "free" (not for sale/resale). --- End quote --- well it's legal to download a backup rom as long as you have the original. just like steam does nowadays, if you allready have an original game and you find it on their servers, all you need to do is use your gamekey and you can download the game for free. now the problem with sites like romnation is they cant prove they released those rom's to the public exclusively for gamers who allready own the original games. |

On the contrary xxdeszarasxx, downloading roms is illegal, no matter if own the original. If you read the legal agreement that have Nintendo you will see that roms are ILLEGAL. |
